ミランダ警告

逮捕のシーンでは、黙秘権などを被疑者に告知しているのをよく見ます。

これは「Miranda Warning」（ミランダ警告）と呼ばれ、「権利の告知」などとも訳されます。アメリカではこの警告をしないで取り調べをしてしまうと、被疑者の供述が法廷で証拠として採用されなくなってしまいます。

ミランダ警告は、取り調べ中に警察の「圧」などにより自供してしまうことを避け、被疑者の黙秘権（米国憲法修正5条）や弁護士選任権（修正6条）を守るために義務付けられたものです。1966年のミランダ氏（男性のラストネーム）対アリゾナ州の裁判がこの呼ばれ方の由来になっています。

ドラマでは省略されたり、途中でフェードアウトしたりすることが多いですが、たまに全部読まれます（読む、というが暗記しているので紙などは見ていない）。

「クリミナル・マインド」シーズン4-12の冒頭では、ある男性を逮捕しに来た刑事がこの「権利の読み上げ」をフルバージョンでやっていました。本来必要な「理解しましたか？」「はい」も省略されていません。

Detective: ＜被疑者名＞, you are under arrest for the kidnapping of ＜被害者名＞ and the murder of 3 women.
You have the right to remain silent.

Suspect: You have a warrant?

Detective: Anything you say can, and will, be held against you, in a court of law.
You have the right to have an attorney present during the questioning.
If you cannot afford an attorney, one will be provided for you.

刑事「＜被疑者名＞、＜被害者名＞の誘拐と女性3人の殺害容疑で逮捕します。

刑事「発言はすべて、法廷であなたに不利な証拠として使われる可能性があります。
あなたには尋問の際に弁護士を同席させる権利があります。
弁護士を雇う金銭的余裕がない場合は、公選弁護人をつけることができます。

被疑者「はい」

黙秘権、供述が不利な証拠となりうること、弁護士選任権、公選弁護人をつける権利の告知が入っていればよく、細部の表現はいろいろです。

「ブラックリスト」シーズン7-14では、ラストで静かにBGMが流れる中、アラム・モジタバイ捜査官がこれを読みます。いつものミランダで全米を泣かす。そんな気概が感じられる演出でした。

Aram: You have the right to remain silent.
Anything you say can and will be used against you in a court of law.
You have the right to an attorney.
If you cannot afford an attorney, one will be provided for you.

※「right to an attorney」だけで「弁護士を雇う権利」になります。

「ミランダ警告を読む」という動詞「Mirandize」もたまに出てきます。

Attorney: You’re holding my client in your custody, and you didn’t even Mirandize her? (Major Crimes 1-3)

弁護士「あなた方は私の依頼人を拘束しながら、ミランダイズもしていなかったのですか？」

Rizzoli: What, our killer’s a zombie?

Korsak: That’d be fun. Probably wouldn’t have to Mirandize him or anything. (Rizzoli and Isles 5-11)

リゾーリ「まさか殺人犯はゾンビ？」
コーサック「だと面白いな。権利とか読んだりする必要もないだろうし」

こちらも動詞の「Miranda」。

カリフォルニアの警察官であるノーランは、ある事件で黙秘権がないことを警告されました。

Commander Percy West: Officer Nolan, per government code 3300 and Lybarger, I am required to advise that you do not have the right to remain silent.
Anything you say can and will be used against you.
Refusal to fully and completely answer all of my questions will result in your immediate termination and referral to the District Attorney for prosecution.
Do you understand?

Nolan: Yes.

West: Having received the Lybarger warning, do you give up your right to remain silent, and will you honestly and without reservation answer all of my questions? (The Rookie 3-1)
